บุคคลพวกหนึ่ง ตั้งอยู่ในความไม่สงบ ทำร้ายเขา ฆ่าเขา หรือทำให้เขาเศร้าโศกแล้วจึงให้ทาน ทักษิณานั้นจัดว่าเป็นทักษิณาอันมีหน้าอันนองด้วยน้ำตา จัดว่าเป็นทานที่เป็นไปกับด้วยอาชญา จึงมีค่าไม่เท่าส่วนแห่งทานที่ให้ด้วยความสงบ."
